Mt. Carmel High
School Associated Student Body Constitution
PREAMBLE
WE, the students of the Associated Student Body of Mt. Carmel High
School, in an effort to establish student participation in school
government; develop standards of education, school spirit, and honor
based on student pride; augment student-faculty cooperation; promote
responsible citizenship in preparing citizens for life in a democratic
society; promote an atmosphere conducive to higher learning; and to form
an organization which shall define, regulate, and control student
activities; do inaugurate and endorse this Constitution for Mt. Carmel
High School.

ARTICLE I
NAME
Section 1. This organization shall be known as the Associated
Student Body of Mt. Carmel High School.
Section 2. The colors of the school shall be scarlet and
gold with an optional white highlight. The school's mascot shall be the
“Sundevil:” and its (the school's) nickname shall be the “Mount.”

ARTICLE II
RESPONSIBILITY AND
AUTHORITY OF THE PRINCIPAL
Section 1. The principal shall be legally responsible for
the actions of the student body and it is understood that he/she shall
have full jurisdiction over all student body affairs.

ARTICLE III
MEMBERSHIP
Section 1. All students regularly enroll in Mt. Carmel High
School shall be members of the Associated Student Body of Mt. Carmel
High School.
Section 2. All members of the Associated Student Body shall
be subject to the rules, regulations and procedures established in this
Constitution and are entitled to the privileges and due process
established herein.
Section 3. Honorary membership shall be extended to all
members of the Mt. Carmel High School faculty and staff. This
membership shall not include the privileges of voting and holding
office.

ARTICLE IV
ELECTION OF COUNCIL
MEMBERS
Section 1. The Student Review Board shall oversee all ASB
elections of the ASB Council and Class Presidents.
Section 2. Procedures for said elections shall be stated in
the by-laws.
Section 3. The elected ASB Council Members shall be
President, Vice-President, Secretary, Treasurer, Activities
Commissioner, Pep Commissioner, Inter-Club Commissioner, President Pro
Tempore of the Senate, Community Commissioner, and Public Relations
Commissioner.
Section 4. All council members shall be elected, as stated
in the by-laws, following an induction ceremony, to assume office on the
first day of summer break and their terms shall end on the last day of
the spring semester.
Section 5. The election of certain ASB Council Members shall
involve the nominating process. A nominating convention shall be held
once a year for this purpose. Rules for the convention shall be stated
in the by-laws.
Section 6. No person may hold two ASB Council positions at
the same time.

ARTICLE V
DUTIES OF COUNCIL
MEMBERS
Section 1. All ASB council members shall:
a. Be enrolled
and participate in the leadership class.
b. Support all ASB
activities, clubs, classes, and organizations, as deemed necessary by
the ASB council.
c. Attend at
least one School Board meeting and one PTSA meeting per semester.
d. Uphold the oath
and duties of their office as stated in the by-laws.

ARTICLE VI
EXECUTIVE COUNCIL
Section 1. The Executive Council shall:
a. Consist of the
ASB President, Vice-President, Treasurer, Secretary, Activities
Commissioner, Inter-Club Commissioner, Community Commissioner.
b. Administer and
manage all ASB affairs.
c. Have the power
to approve disbursements, transfers, and loans to organizations of no
more than $300 from the ASB general accounts. In situations deemed
necessary by the ASB Council, the Executive Council may exceed the $300
limit as necessary.
d. Have the power
to veto once any legislation passed by the Student Senate, with a
two-thirds majority.
e. Meet weekly on
a designated day, as stated in the by-laws.
f. Have at least
one formal meeting per month open to the student body.
Section 2. The ASB Council shall
a. Have a quorum
of two-thirds shall be necessary to conduct an official ASB business.
b. Members shall
be defined in the by-laws.
Section 3. ASB Council Meetings shall be conducted
according to parliamentary procedure as stated in ROBERT’S RULES OF
ORDER, REVISED.
Section 4. The ASB President shall preside over the ASB
Council and vote only in case of a tie.

ARTICLE VII
STUDENT SENATE
Section 1. Student Senate shall consist of representatives
from each contact class, as stated in the by-laws.
Section 2. The presiding officer of the Student Senate shall
be the President Pro Tem of the Senate who will vote only in case of a
tie.
Section 3. A quorum of one half shall be necessary to conduct
any official Student Senate business.
Section 4. Student Senate shall meet at least once a month on
a specified day, as stated in the by-laws.
Section 5. Meetings shall be conducted according to
parliamentary procedures as stated in ROBERT’S RULES OF ORDER,
REVISED.
Section 6. Student Senate Representatives shall be responsible
for a complete report to their representative contact classes on the
proceedings of the Senate. They shall attend all Student Senate
meetings.
Section 7. The Student Senate shall:
a. Approve or
reject all appointed SRB justices and ASB Council Members
b. Approve or
reject the ASB budget.
c. Be able to
override an ASB Council vote/veto by a two-thirds majority vote.
d. Establish
committees to assist in student government.
e. Approve
existence of any new club.
f. Initiate and
pass legislation as needed by a simple majority.

ARTICLE VIII
STUDENT REVIEW BOARD
Section 1. The Student Review Board’s areas of jurisdiction
are ASB Officer and Class Elections an oversight of Clubs/Organizations.
Section 2. The Student Review Board shall:
a. Provide a
means of receipt of signed complaints concerning violations of the
Student Review Board’s area of jurisdiction of the school code as stated
in the by-laws.
b. Suggest
appropriate actions or punishments for violators of the aforementioned
areas of the school code.
c. Have the power
to conduct hearings and investigations.
d. Validate all
club constitutions, and elections.
Section 3. Selection of Student Review Board members:
a. All Student
Review Board members shall be appointed for an indefinite term by the
existing Student Review Board in consultations with a committee of
faculty and administrators. Their recommendation shall be approved by
the Student Senate. Appointment procedures stated in the by-laws.
b. The Student
Review Board shall consist of eleven members:
1. Four seniors,
three juniors, two sophomore, and two freshman.
2. If, in the
opinion of the Board, no qualified students apply to meet the quotas,
the Board at that time may fill the positions with students from any
grade level.
3. One upper class
member shall be elected by the Student Review Board to serve, for one
year, as Chief Justice with duties stated in the by-laws.
Section 4. Vacancies shall be created on the Student Review
Board by graduation, resignation, or removal as stated in Article XI.
Section 5. A quorum of two-thirds is necessary to conduct
any official business by the Student Review Board.

ARTICLE IX
CLUBS, CLASSES, AND ORGANIZATIONS
Section 1. The Inter-Club Commissioner shall be the liaison
between individual clubs, classes, and organizations and the ASB Council
for all ASB affairs.
Section 2. The procedure for organizing a club shall be:
a. A petition
stating the name, purpose, required dues (if any), membership
requirements, faculty adviser; signed by at least 20 Mt. Carmel Students
who are prospective members, must be submitted to the Inter-Club
commissioner.
b. A constitution
must be drafted by the proponents and be reviewed and validated by the
Student Review Board.
c. A club shall
exist after a simple majority approval of the Student Senate.
Section 3. Each club, and class shall have a President,
Vice-President, Secretary, and Treasurer.
Section 4. The President or a person appointed shall act as
the official representative of each club or class at all Inter-Club
Council meetings.
Section 5. Class and club elections shall take place as
stated in the by-laws.
Section 6. Each club and class shall finance its own
activities.
Section 7. Clubs and classes shall meet regularly as stated
in the by-laws.
ORGANIZATIONS
Section 8. Groups, which represent and benefit the entire
student body, shall be considered an organization.
Section 9. ASB organizations must be under the direct
authority of a certified Mt. Carmel teacher.
Section 10. ASB organizations may receive general ASB funds.
Section 11. Groups meeting the requirements in Section 8 and
9 shall be considered ASB organizations.
Section 12. A member from each ASB organizations shall be
selected and act as the official representative at all Inter-Club
meetings.

ARTICLE X
LEGISLATION
Section 1. Definitions:
a. Any legislation
which amends the structure of the government shall be considered a
constitutional amendment.
b. Any legislation
which deals with rules and regulations of government shall be considered
a by-law.
Section 2. Procedure for initiating legislations:
a. Any member of
the ASB may initiate legislation.
b. A petition signed
by at least five percent of the entire student body must be presented
to a Student Senator and filed with the Executive Council and the
Student Review Board.
Section 3. Passage of a Constitutional Amendment:
a. A proposed
amendment must be placed on the ballot of a regular or special election
if it receives a two-thirds majority approval of the Student Senate.
b. In order to
amend the ASB Constitution, the proposed amendment must receive a
two-thirds vote of approval by the student body in a regular or special
election in which more than 50% of the entire student body voted.
Section 4. Passage of a by-law:
a. A proposed
by-law becomes a law when it receives a simple majority vote approval by
the Student Senate and the approval of the ASB President.

ARTICLE XI
CREATING AND FILLING VACANCIES
Section 1. Vacancies:
a. Vacancies in
ASB offices shall be created by the processes of recall, impeachment,
declaration of vacancy, and resignation.
b. Vacancies
created in the ASB offices by impeachment or recall mandate that a
special election be held to fill the vacancies.
c. Vacancies
created in ASB offices by resignation or declaration of a vacancy
mandate that the ASB President make an appointment subject to simple
majority approval of the Student Senate.
Section 2. Recall-an ASB officer can be recalled in two-ways:
a. A petition
signed by two-thirds of the entire student body.
b. A two-thirds
majority voted in a regular or special election mandate by a recall
petition of 20% of the student body.
Section 3. Impeachment:
a. An ASB officer
may be impeached on the grounds of negligence of duties and/of violation
of a by-law or a constitutional law.
b. The ASB Council
or House may impeach an officer by a two-thirds majority vote, indicting
him/her with express written charges.
c. The Student
Review Board may then convict the officer of negligence of duties and/or
law with at least seven affirmative votes.
d. An officer
convicted in an impeachment trial is then officially removed from
office.
Section 4. Declaration of Vacancy:
a. A vacancy of
office shall be declared by the ASB Council if for any reason an ASB
officer does not or cannot fulfill the requirements of his/her office.
Section 5. Resignation:
a. If an ASB
officer wishes to resign, he/she shall submit a formal letter of
resignation to the ASB President/Advisor.

ARTICLE XII
STUDENT’S RIGHTS
Section 1. The Mt. Carmel ASB shall not in any way discriminate
on the basis of race, ethnic origin, religious beliefs, or sex.
Section 2. Students are guaranteed all other rights outlined in
Federal, State, and District Education Codes.

ASSOCIATED STUDENT BODY BY-LAWS
ARTICLE IV
Section 3. Those who wish to be appointed to the Student
Review Board shall submit an application, available in the ASB office or
designated place, to the Student Review Board Adviser. The applicant
will be required upon request to interview with the Board members. The
Student Review Board will conclude after the interview whether or not
the applicant should be admitted to the Board. Before official
appointment to a justice position, the chosen applicant must be approved
by the Student Senate by a 50% plus 1 majority vote.
ARTICLE VI
Section 1. All Executive Council officers shall attend
designated weekly meetings usually held during ASB Leadership class
during a lab period. An Executive Council member may only be excused
from a meeting with special permission from ASB President or ASB
adviser.
ARTICLE V
Section 2. The President shall:
a. Serve as
official representative of the student body.
b. Develop an agenda
for and preside over all ASB Council meetings.
c. Vote only in
case of a tie in the ASB Council.
d. Give an ASB
Student Union address at the beginning of each semester.
e. Have the power
to fill, by appointment, any vacancy occurring in elected offices with a
majority approval of the Senate.
f. Assist and
oversee the other ASB council members in the completion of their duties
and responsibilities.
g. Have the power
to assemble and head committees as necessary.
h. Determine which
formal ASB Council meetings will be open to the student body
i. Oversee the
operation of all ASB concessions.
j. Write the CASC
report.
k. Plan an All
School Awards Assembly
Section 3. The Vice-President shall:
a. Assist the
President in developing the agenda for ASB Council meetings
b. Assume the
duties of the ASB President in the President’s absence and advance to
the presidency should the office become vacant.
c. Assist and
oversee the other ASB officers in the completion of their duties and
responsibilities.
d. Be the
President of the Senate
e. Plan and
coordinate Homecoming activities.
Section 4. The Secretary shall:
a. Take care of all
correspondence between Mt. Carmel and other individuals and/or groups.
b. Record and make
available minutes of all ASB Council meetings to all students,
government leaders, faculty, and administrators.
c. Maintain files
of all documents pertaining to ASB government so that these files are
easily accessible by all interested persons.
d. Prepare and
distribute agenda for ASB Council meetings.
e. Prepare an
officer information report at the beginning of each semester that
includes name, address, phone number, birth date, and schedules of all
classes with teacher and phone number.
f. Work with the
Historian to compile and publish an annual report of all ASB Council
meetings of the year.
Section 5. The Treasurer shall:
a. Oversee all matters
concerning ASB funds.
b. Approve and
sign all ASB checks.
c. Prepare and present
a detailed report of all ASB income and expenses at the first Executive
Council meeting of each month.
d. Research
possible fundraisers for clubs, classes, and ASB, and compile a booklet
of same to be completed by the end of the officer’s term.
e. Compile a yearly
financial summary and prepare a budget for the upcoming school year to
be approved before the last day of the school year.
Section 6. The Activities Commissioner shall:
a. Plan and
coordinate all ASB activities such as talent shows, Class of the Year
Competition, and special assemblies.
b. Chair the
Activities Committee
c. Research
possible activities for clubs, classes and ASB, and compile a booklet of
same to be completed by the end of the officer’s term.
d. Publish and
maintain an activity calendar for the upcoming school year prior to the
start of the school year.
e. File and
distribute requests
Section 7. The Pep Commissioner shall:
a. Plan and
coordinate all pep rallies and assist the Activities Commissioner with
special assemblies
b. Chair the Pep
Committee.
c. Work with the
Public Relations Commissioner to publicize.
Section 8. The Public Relations Commissioner shall:
a. Publicize all
ASB activities.
b. Chair the
Public Relations Committee.
c. Assist clubs,
classes, and organizations with publicity.
d. Enforce
publicity regulations.
e. Maintain and
account for all publicity supplies
f. Communicate
to students, faculty, and community a positive image of Mt. Carmel.
Section 9. The Inter-Club Commissioner shall:
a. Serve as liaison
between clubs, classes, and organizations and the ASB
b. Chair the
Inter-Club council consisting of a representative from each club, class,
and organization.
c. Hold an Inter-Club
council meeting at least once a month.
d. Assist students
wanting to form a new club.
e. Plan and coordinate
a spring club fair and a fall club membership drive.
f. Determine
involvement points for Class of the Year Competition.
g. Coordinate Student
Reward System, procedures shall be stated in the by-laws.
h. Maintain and update
ASB files relating to clubs and organizations.
Section 10. The President Pro-Tem of the Senate (ASB Vice
President)shall:
a. Develop an agenda
for and preside over all the Student Senate meetings
b. Call a Student
Senate meeting at least once a month
c. Have the power to
assemble as many committees as needed.
d. Record,
maintain, and make available all Student Senate meeting minutes
Section 11. The Community Commissioner shall:
a. Represent the
interests of Mt. Carmel students at all PTSA and School Board meetings.
b. Review all
issues confronting the PTSA and determine their effects on Mt. Carmel.
c. Report PTSA
and School Board matters at Executive Council meetings.
d. Conduct an
opinion poll at least twice a year.
Section 12. The Historian shall:
a. Maintain an
official scrapbook of the history of Mt. Carmel to be presented at the
last Executive Council meeting of the year.
b. Take and
organize slides and student activities.
c. Work with the
Secretary to compile and publish an annual report of all ASB Executive
Council meetings of the year.
Section 13. The Recognition Commissioners shall:
a. Establish a
yearly student recognition program.
b. Award deserving
students on a monthly basis.
c. Work with the
faculty commissioner to honor deserving Faculty/Staff/Administrators on
a regular basis.
d. Assist the ASB
President in his/her duty to organize and carry out a school Awards
Assembly program to honor Outstanding Student Performance.
e. Chair a
student recognition committee.
f. Communicate
names of students and staff who have received recognition awards to the
school newspaper, principal, and Community Commissioner.
Section 14. The Welcome Commissioners shall:
a. Organize and carry
out a Freshman Orientation Day.
b. Organize and
carry out a new Student Orientation Day.
c. Organize an on-going
program for new students at Mt. Carmel High School.
d. Work with other
members of the ASB Council to write the Student Handbook.
e. Chair the Welcome
Dance Committee.
f. Develop a program
to welcome new Faculty members along with the Faculty Commissioner.
g. Develop a program to
make substitute Faculty Members feel welcome.
Section 15. The Faculty Commissioner shall:
b. Coordinate a
Secret Pal program for members of the Faculty.
c. Chair Staff
Recognition Week Activities.
d. Attend faculty
meetings when possible to
1. Inform Faculty
meetings when possible to needs/concerns.
2. Report to the
ASB Council the needs/concerns of the Faculty.
e. Work with the
Recognitions Commissioner to honor outstanding faculty members.
f. Work with
Welcome Commissioners to plan a yearly program to welcome new teachers
and substitutes.
Section 16. The Election Commissioner shall:
a. Chair the ASB
Nominating Convention.
b. Be responsible
for coordination of all election activities.
c. Be responsible
for coordinating all activities for Class Election candidates.
Section 17. The Fine Arts Commissioner shall:
a. Report to the
ASB Council on a regular basis, all performing arts activities.
b. Develop a year
round recognition program to honor outstanding performances by
individual members.
c. Develop a year
round recognition program to honor outstanding performances by
individual members of organizations and clubs in the area of fine arts.
d. Be the liaison
between Fine Arts and the ASB Council regarding budgetary needs.
e. Develop a
special recognition program for the advisers, directors, and coaches of
the fine arts program at Mt. Carmel.
Section 18. The Athletic Commissioner shall:
a. Develop a
program to recognize members of every athletic team and Mt. Carmel High
School
b. Be the liaison
between the Athletic Director and the ASB Council on budgetary needs.
c. Work with the
Pep Commissioner and Activities Commissioner to ensure that all Athletic
Teams are recognized at Pep rallies.
d. Organize a
special program to honor all Mt. Carmel Athletic Teams which qualify for
C.I.F. competition.
e. Develop a
special recognition program for MCHS coaches.
f. Work with the
Pep Commissioner and Public Relations Commissioner to promote all home
games
Section 19. The Music Commissioner shall:
a. Upkeep
maintenance of all equipment.
b. Be in charge of
tech setup of all activities.
ARTICLE IX
Section 1. The Chief Justice of the Student Review Board shall:
1. Call and
preside over meetings.
2. Act as official
representative of the Student Review Board.
3. Appoint
officers as deemed necessary by the board with the approval of the
Board.
